By using this website or booking a tour with Alamaya Adventures Ltd. (“the Company”), you (“the Customer”) agree to these Terms and Conditions, forming a legally binding contract. These terms apply to all Company services, booked online, via email, or by phone.

2. Booking and Confirmation

2.1. A booking is confirmed upon receipt of a confirmation email with an invoice and the required deposit or full payment.

2.2. The Customer is responsible for providing accurate information during booking. The Company is not liable for issues arising from incorrect information.

2.3. By booking, you confirm you have read and accepted these Terms and Conditions on behalf of yourself and all travelers in your group.

3. Tour Limitations and Customer Responsibility

3.1. While the Company strives for safe and enjoyable tours, certain limitations exist: * Force Majeure: The Company is not liable for cancellations, delays, or changes due to events beyond its control (e.g., natural disasters, strikes, political instability, extreme weather). * Liability: The Company is not liable for personal injuries, illnesses, or loss of personal belongings unless caused by its negligence. The Company is not responsible for third-party services (e.g., airlines, transport).

3.2. Customers are responsible for their personal safety and must follow guide/staff instructions.

3.3. Customers are strongly advised to purchase comprehensive travel insurance covering health, accidents, and cancellations.

4. Itinerary and Website Information

4.1. The Company reserves the right to revise or update website information and tour itineraries.

4.2. Minor itinerary changes may occur due to unforeseen circumstances and will be communicated promptly.

4.3. Significant changes (e.g., cancellations, major component changes) will offer alternatives or a refund.

4.4. While website accuracy is a priority, errors may occur. The Company reserves the right to correct errors in prices, descriptions, and itineraries without notice. 4.5. Significant booking revisions will be communicated via email or phone.

5. Company Changes and Cancellations

5.1. The Company may cancel or modify tours due to unforeseen circumstances (e.g., extreme weather, safety concerns, guide unavailability).

5.2. In case of cancellation, the Customer may reschedule, choose an alternative tour, or receive a full refund.

5.3. Customers will be notified of cancellations or major changes as soon as reasonably possible.

6. Customer Changes and Cancellations

6.1. Cancellation Policy: * 60+ days before the tour: Loss of deposit. * 31-60 days before the tour: 50% of the total cost. * 30 days or less before the tour: 100% of the total cost.

6.2. Refunds will be processed within 30 days of the cancellation request.

6.3. Change requests (e.g., dates, group size) must be submitted to [Your Email Address]. Additional fees may apply.

7. Special Requests

Customers with special requests (e.g., dietary, accessibility) must notify the Company in writing at least 7 days before the tour. While the Company strives to accommodate requests, it cannot guarantee them.

8. Safety and Conduct

8.1. The Company adheres to Kenyan Tourism Safety Regulations and prioritizes customer safety.

8.2. Customers must follow guide/staff instructions. Failure to comply may result in removal from the tour without a refund.

8.3. Customers are strongly advised to purchase travel insurance covering personal injury, medical emergencies, and cancellations.

8.4. Code of Conduct: Customers must behave respectfully. Unacceptable behavior (e.g., harassment, excessive alcohol consumption, illegal substance use, endangering others) may result in removal from the tour without a refund and refusal of future bookings.

9. Complaints

Report any problems during the tour to your guide immediately. Unresolved issues should be submitted in writing to [Your Email Address] within 28 days of the tour’s end. Complaints received after this period may not be addressed.

10. Data Protection

The Company complies with the Kenyan Data Protection Act (2019). Customer data will be used to manage bookings, provide updates, and send promotional offers (if opted in). Data will not be shared with third parties without consent, except to fulfill bookings or meet legal obligations.

11. Modifications to Terms

The Company reserves the right to update these Terms and Conditions at any time. Updates will be effective immediately upon posting on the website. Customers are responsible for periodically reviewing these terms. Continued use of services after updates constitutes acceptance of the revised terms.
